1. Acceptance of Terms
By continuing to use the MotoPal mobile application (“App”), you agree to be bound by these Terms and Conditions (“Terms”) as well as the Privacy Policy and other applicable policies. You must also confirm acceptance via the checkbox presented in-app. If you do not agree to these Terms, you may not use the App.
2. Eligibility
To use the App, you must be at least sixteen (16) years old and not otherwise barred from using the App under the laws of your jurisdiction. If you are under the age of majority in your province or territory, you confirm that you have permission from a parent or legal guardian to use the App.
If you are an L (Learner) or N (Novice) driver in British Columbia or another region with restrictions on mobile device use, you must not use the App’s active feedback or in-motion features while driving. It is your responsibility to comply with provincial or territorial driving laws at all times. Users must not interact with the App while driving unless permitted by law and safe to do so.
3. License to Use the App
We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App solely for personal, non-commercial purposes in accordance with these Terms.
4. User Conduct
You agree to use the App responsibly and lawfully. You may not use the App to interfere with, harm, or attempt to disrupt its functionality or access any unauthorized areas of the service. You are responsible for all activity under your account. Do not share your account or allow others to use the App on your behalf.
5. User Content
If you submit any driving data or content through the App (“User Content”), you grant MotoPal Driving App Inc. a worldwide, royalty-free license to use, reproduce, modify, and distribute your User Content as necessary for the App’s features and services. You are responsible for ensuring your submissions do not violate any laws or infringe on any third-party rights.
We do not sell your personal data or driving content to third parties. Any data shared with third-party services (e.g., mapping or analytics providers, such as TomTom, Firebase) is anonymized or used only to support core functionality as described in our Privacy Policy. Use of those services may be subject to separate terms and privacy policies.
6. Disclaimer of Warranties
The App is provided on an “as is” and “as available” basis. We make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the App will be secure, error-free, or uninterrupted.
7. Limitation of Liability
To the fullest extent permitted by law, MotoPal Driving App Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. You should not rely on the App as a safety or emergency system.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia, Canada.
9. No Guarantees / Not Professional Advice
MotoPal is designed as a self-guided tool to support personal awareness and growth in driving habits. However, it is not a certified driver training program, legal advisor, or safety authority. We make no guarantees that using the App will improve your driving behavior, safety, legal compliance, or test results. All feedback and insights are provided for informational purposes only and are not a substitute for professional instruction or judgment. You are solely responsible for your driving decisions and compliance with applicable laws.
10. Changes to Terms
We reserve the right to update or modify these Terms at any time. Changes become effective once posted. You are encouraged to review them regularly.
11. Communications & Notifications
We may use the email address provided through your sign-in method (e.g., Google or Apple) to contact you about important updates, including changes to the App, Terms or Privacy Policy, and in the event of a security incident or data breach.
If you sign in using Apple and have chosen to hide your email, notifications will be sent to your Apple relay email address. It is your responsibility to ensure you can receive messages from MotoPal through that email.
